Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Entranced: AI Dating Simulator (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

The App is operated by Ben Hayward (“we”, “our”, “us”), contactable at support@entranced.ai.

2. Age Requirement

You must be at least 18 years old to use Entranced. The App contains AI-generated content of a mature and sexually suggestive nature. By using the App, you represent and warrant that you are at least 18 years of age.

We verify your age during onboarding using your date of birth and, where available, Apple's declared age range. Users who cannot verify they are 18 or older are denied access.

We reserve the right to terminate accounts where we reasonably believe the user is under 18.

3. Account Registration

You sign in using Sign in with Apple or Sign in with Google. You are responsible for maintaining the security of your account and for all activity that occurs under it. You may delete your account at any time through the App's settings.

You may only maintain one account. We reserve the right to terminate duplicate or fraudulent accounts.

4. Description of Service

Entranced is an AI-powered dating simulation for entertainment purposes. The App provides:

• AI-generated fictional characters with profiles, images, and personalities
• Simulated text messaging conversations with AI characters
• AI-generated voice notes from characters
• Simulated dates at fictional venues with cinematic intros and AI conversation
• Cross-device sync so your progress carries across devices
• A simulated dating app interface

All characters, conversations, images, and interactions within the App are entirely fictional and AI-generated. No real people are depicted or involved.

5. AI-Generated Content

You acknowledge and agree that:

• All characters, conversations, images, and voice content are generated by artificial intelligence and are entirely fictional
• AI-generated images are pre-created, synthetic, and do not depict real individuals
• AI responses may occasionally produce inaccurate, inappropriate, or unexpected content
• Voice notes use AI voice synthesis — you are not hearing a real person
• The App may contain sexually suggestive content, but does not contain full nudity or pornographic material
• We do not guarantee the quality, accuracy, or appropriateness of AI-generated content at all times

6. Content Moderation

Your messages are automatically screened by a safety classifier to detect content that may involve minors, self-harm, extreme violence, or impersonation of real people. Flagged content may result in warnings or account restrictions. We reserve the right to restrict or terminate accounts that repeatedly violate our content policies.

7. Subscriptions & Payment

Entranced offers the following subscription plans:

• Monthly: $19.99/month
• Yearly: $96.99/year

Voice Note Packs

In addition to subscriptions, we offer voice note packs as one-time consumable purchases. These provide a set number of voice notes that are deducted as you use them. Voice note packs do not expire.

Auto-Renewal

Subscriptions automatically renew unless you cancel. By subscribing, you agree to the following:

• Payment is charged to your Apple ID account at confirmation of purchase
• Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan
• You can manage and cancel your subscription at any time via your device's Settings > Apple ID > Subscriptions
• Any unused portion of a free trial period (if offered) is forfeited upon purchase of a subscription
• Price changes will be notified in advance and require your consent where required by applicable law

Refunds

All purchases are processed by Apple. Refund requests must be made through Apple's support channels in accordance with their refund policy.

8. Free Tier

The free tier provides limited access to AI features with daily usage limits. Certain features (including but not limited to voice notes, dates, and unlimited messaging) require an active subscription.

9. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to bypass rate limits, security measures, or abuse the service
• Reverse engineer, decompile, disassemble, or extract source code from the App
• Use the App to generate, solicit, or distribute content that exploits or sexualises minors in any way
• Resell, redistribute, sublicense, or commercially exploit the App or its content
• Use automated systems, bots, or scripts to access the service
• Attempt to interfere with or disrupt the App's infrastructure
• Impersonate another person or misrepresent your identity or age
• Share your account credentials or allow others to access your account

10. Intellectual Property

The App, including its design, code, branding, AI models, character designs, and all associated intellectual property, is owned by Ben Hayward or licensed to us.

AI-generated content (text, images, voice) created during your use of the App is provided for your personal, non-commercial entertainment only. You may not reproduce, distribute, or commercially exploit any content generated by the App.

11. Disclaimers

• The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Entranced is an entertainment product. It is not a substitute for real human relationships, therapy, counselling, or professional advice of any kind.
• We do not guarantee uninterrupted, error-free, or secure service. AI services may experience downtime, degradation, or rate limiting.
• We are not responsible for the actions or policies of third-party AI service providers.
• We do not guarantee that content generated will meet your expectations or be free of errors.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total liability to you for any claims arising from or related to the App shall not exceed the amount you have paid us in the 12 months preceding the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
• Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

13. Termination

We may suspend or terminate your account immediately if you violate these Terms. You may delete your account at any time through the App's settings.

Upon termination or deletion:

• All server-side data (account information, conversations, memories, date history, and preferences) will be permanently deleted within 30 days.
• Data stored locally on your device remains until you uninstall the App.
• Active subscriptions must be cancelled separately through Apple's subscription management.
• Unused voice note balances are forfeited upon account deletion.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, through in-app notification. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these Terms affects your statutory rights as a consumer under applicable law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
